Are security guards at residential buildings allowed to wear “body cameras” while on duty
The Enquiry
A residential building’s property management company proposes requiring security guards to wear body-worn cameras while on duty and seeks advice on whether this practice would contravene the requirements of the Ordinance.
Our Response
Before using body-worn cameras in the course of their duties, data users should assess whether such use is necessary, reasonable, and proportionate to the intended purpose, while also considering whether there are alternative measures that would have a lesser impact on personal privacy. In conducting the assessment, they should balance the seriousness of the problem against the degree of impact on personal data privacy. For example, they should consider whether the frequency of crime incidents is sufficient to justify the use of body-worn cameras, which carry a higher privacy risk. Where practicable, data users should also consult individuals who may be affected in order to understand their privacy concerns and take appropriate measures to mitigate the associated risks.
The property management bodies may make reference to the “Guidance on the Use of CCTV Surveillance” issued by the PCPD regarding personal data privacy considerations when using such equipment. Besides, the PCPD has issued “Tips on the Use of CCTV Surveillance” to provide some practical tips to data users on the responsible use of body cameras, including:-
