What's New - Reaching Out to the Community － Privacy Commissioner Interviewed by Media to Explain Three Cases Involving Misuse of Employers’ Personal Data by Foreign Domestic Helpers for Loan Applications and Guidance on “Protecting Personal Data Privacy

During the interview, the Privacy Commissioner said that all three FDHs had provided the employers’ personal data to financial institutions without the employers’ knowledge or consent. The personal data involved included the employers’ names, residential addresses and telephone numbers. She pointed out that the PCPD had issued warning letters to the FDHs concerned, warning them that they had contravened the requirements of the Personal Data (Privacy) Ordinance (PDPO) regarding the use of personal data.
The Privacy Commissioner noted that the Government had strengthened the regulation of licensed money lenders with effect from August, including prohibiting money lenders from requiring borrowers to provide loan referees. She believed that the measure would help reduce the misuse of employers’ personal data.
In addition, the Privacy Commissioner noted that agentic artificial intelligence (AI) can operate with a high degree of autonomy and execute multi-step tasks on behalf of users, from managing emails and making reservations to processing payments. As a result, it poses greater risks to personal data privacy than conventional AI chatbots. The Guidance sets out nine practical recommendations to assist organisations in using agentic AI safely and responsibly while complying with the relevant requirements of the PDPO .
