Application of the Personal Data (Privacy) Ordinance Code of Practice on Human Resource Management Frequently Asked Questions About Recruitment Advertisements
Background The Privacy Commissioner for Personal Data issued a Code of Practice on Human Resource Management ("the Code") pursuant to the requirements of the Personal Data (Privacy) Ordinance ("the Ordinance") on 22 September 2000 concerning employment-related personal data privacy. The Code came into effect on 1 April 2001.
In
relation to recruitment advertisements, the Code requires
that parties that place recruitment advertisements must
identify themselves and state the purpose for which
the data are to be used IF they directly solicit personal
data from job applicants in a recruitment advertisement.
This fact sheet examines the particular requirements
of the Code in respect of recruitment advertisements.
