The Privacy Commissioner for Personal Data Mr. Raymond Tang has toady approved amendments to the Code of Practice on Consumer Credit Data and the revised Code will be gazetted tomorrow (23 May) and take effect on 2 June 2003.

The Code provides practical guidance to financial institutions and credit reference agencies in the handling of consumer credit data.

In response to the financial industry's proposals to alleviate the increasing number of consumer indebtedness and personal bankruptcies, the Office of the Privacy Commissioner for Personal Data (PCPD) conducted a public consultation exercise in August 2002 to gauge public opinions on the proposals.  A total number of 282 submissions were received.  Respondents generally supported the proposals.  After careful consideration, the Code is revised to allow a wider range of positive consumer credit data to be shared between financial institutions and credit reference agencies.  A set of protection safeguards in relation to the amendments is imposed to protect individuals' personal data privacy.

To help the general public understand how their credit data should be handled by financial institutions and credit reference agencies under the Code, the PCPD will publish a fact sheet for distribution. 

Copies of the revised Code and the fact sheet will be available for download on the PCPD website (www.pcpd.org.hk) under the section "The Ordinance/Codes of Practice" and "Publications and Videos" respectively.
